Terms & Conditions (“T&C”). If you disagree, do not use the Platform.

1. Definitions

“Platform”: LankaSriMart.com’s website, mobile app, and services.
“User”: Farmers, manufacturers, suppliers, buyers, or agents using the Platform.
“Content”: Product listings, messages, reviews, or uploaded data.
“Applicable Laws”: Sri Lankan, UK (including GDPR), and international trade regulations.

2. Eligibility & Registration

Users must be 18+ or legally authorized to represent a business.
Businesses must provide valid documentation (e.g., company registration, tax IDs, export licenses).
Prohibited Users: Sanctioned entities, fraudulent actors, or those violating export laws.

3. User Responsibilities

Accurate Listings: Product descriptions must match quality, origin, and certifications.
Legal Compliance: Users must adhere to:
Sri Lankan Export Control Laws (e.g., Customs Ordinance).
UK Import Regulations (e.g., Border Control, tariffs).o International Trade Laws (e.g., INCOTERMS, CITES for restricted goods).
Fraud Prevention: Chargebacks, counterfeit goods, or misrepresentation may lead to legal action.

4. Transactions & Payments

Contract Formation: Buyers and sellers enter into direct agreements; the Platform is not a party.
Payment Methods: Bank transfers, escrow services, or approved gateways (e.g., PayPal, Stripe).
Taxes & Duties: Buyers are responsible for import taxes/VAT under UK/Sri Lankan law.
Disputes: Users must resolve conflicts independently; the Platform may mediate but bears no liability.

5. Prohibited Activities

Users may not:

Trade illegal items (e.g., counterfeit goods, restricted agricultural products).
Violate sanctions (e.g., OFAC, UK/EU embargoes).
Bypass the Platform for offline transactions (fee avoidance).
Misuse data under GDPR (EU/UK) or Sri Lanka’s Data Protection Act (2022).

6. Intellectual Property (IP)

Sellers confirm they own/have rights to sell listed products.
Platform IP: Logos, software, and content belong to [Your Platform Name]; no unauthorized use.

7. Liability & Disclaimers

No Warranty: The Platform does not guarantee product quality or transaction success.
Limitation of Liability: We are not liable for:o User disputes or financial losses. o Shipping delays, customs seizures, or force majeure (e.g., pandemics, political unrest).

8. Data Protection

GDPR (UK/EU Users): We process data lawfully; users may request access/deletion.
Sri Lankan DPA: Personal data is stored securely; no unauthorized sharing.
Third Parties: Payment processors may collect data under their policies.

9. Termination

We may suspend/terminate accounts for violations, with or without notice.

10. Governing Law & Dispute Resolution

Primary Jurisdiction: Sri Lankan law governs these T&C.
Alternative Dispute Resolution (ADR): Arbitration in Colombo, Sri Lanka (UNCITRAL Rules).
UK/EU Users: May pursue claims in local courts under GDPR.

11. Changes to T&C

Updates will be posted on the Platform. Continued use implies acceptance.
